1. Introduction

Welcome to the Lawrence B Primak website. We are dedicated to providing masterfully hand-shaped custom surfboards and related services. When you access or use this website, you, as the user, agree to be bound by these Terms of Service. These terms constitute a legally binding agreement between you and Lawrence B Primak. Please review them carefully. Your use of this website signifies your acceptance of these terms.

2. Custom Surfboard Orders

At Lawrence B Primak, every custom surfboard is a bespoke creation, tailored to your specifications and surfing style. The process begins with a detailed consultation to discuss your ideal board.

A. Deposit Policy

To initiate the shaping of any custom surfboard, a non-refundable 50% deposit of the total quoted price is required. This deposit secures your place in our shaping queue and covers the initial material costs and design time. Work will not commence until this deposit is received.

B. Estimated Timelines

We pride ourselves on precision and craftsmanship, which takes time. All completion dates provided for custom surfboards are good-faith estimates. These timelines can be influenced by factors such as material availability, current workload, weather conditions (for resin work), and the complexity of the design. While we strive to meet all estimates, they are not guaranteed and should not be considered fixed deadlines. We will keep you informed of your order's progress.

C. Cancellations & Changes

Due to the custom nature of our products, once the 50% non-refundable deposit has been paid and work has begun, significant changes to the design or cancellation of the order may not be possible or may incur additional fees. Any changes requested after the initial design approval must be submitted in writing and are subject to approval by Lawrence B Primak, with potential adjustments to the final price and delivery timeline. The initial deposit remains non-refundable in the event of cancellation by the client.

3. Repair Services

We offer expert repair services to bring your beloved board back to life.

A. Repair Quotes

All repair quotes are initial estimates based on visual inspection. The final cost of a repair may vary depending on the extent of hidden damage discovered during the repair process (e.g., waterlogging, delamination under unseen cracks). We will endeavor to communicate any significant changes to the repair cost before proceeding with the additional work.

B. Liability for Boards

While your board is in our care, Lawrence B Primak takes reasonable precautions to ensure its safety. However, we are not liable for incidental damage, theft, or loss of boards left at the studio beyond 30 days after the completion of the repair and notification to the client. Please arrange for prompt pickup of your repaired surfboard.

C. Repair Warranty

We stand by the quality of our repair work. All repairs are warranted against defects in workmanship for 30 days from the date of pickup. This warranty does not cover new damage, damage caused by improper use, or normal wear and tear. Any claims under this warranty must be reported immediately upon discovery of the defect.

4. Disclaimers and Limitation of Liability

Please read these disclaimers and limitations carefully, as they govern your engagement with Lawrence B Primak's products and services.

A. Disclaimer of Warranties

ALL PRODUCTS AND SERVICES PROVIDED BY LAWRENCE B PRIMAK ARE OFFERED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE FUNCTIONS CONTAINED IN OUR PRODUCTS OR THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.

B. Inherent Risks of Surfing

Surfing is an inherently dangerous sport with inherent risks of injury, serious bodily harm, or death. By purchasing or using a surfboard from Lawrence B Primak, you acknowledge and accept these risks. You agree that Lawrence B Primak is not responsible for any injuries or damages that occur while using our products, regardless of their condition.

C. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, LAWRENCE B PRIMAK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (i) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE PRODUCTS OR SERVICES; (ii) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES; (iii) ANY CONTENT OBTAINED FROM THE SERVICES; OR (iv) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT. THE AGGREGATE LIABILITY OF LAWRENCE B PRIMAK FOR ALL CLAIMS RELATING TO THE PRODUCTS AND SERVICES SHALL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS (U.S. $100.00) OR THE AMOUNT YOU PAID LAWRENCE B PRIMAK FOR THE SPECIFIC SERVICE OR PRODUCT. THIS LIMITATION OF LIABILITY IS PART OF THE BASIS OF THE BARGAIN BETWEEN YOU AND LAWRENCE B PRIMAK.

D. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the state and federal courts located within Broward County, Florida, to resolve any dispute or claim arising from these Terms or the use of our services or products.
